Limited Warranty: Terms and Conditions
The CCM's Warranty Returns process may be amended from time to time at the sole discretion of the CCM. This Limited Warranty applies to Product hardware only. This Limited Warranty applies only to Products purchased from CCM ("Products'Hardware").
The warranty obligations are limited to the terms set forth below:
When does the Warranty Period Begin?
The Warranty Period begins on the order fulfillment date (i.e. the date products are shipped from CCM). The Warranty Period is,
- one (1) year for programming hardware (i.e. USB dongle programmers and Universal Programmers) and Key FOBs;
- three (3) years for CM3 modules;
- five (5) years for other products sold in North America and South Korea; and
- three (3) years in all other areas.
What does the Limited Warranty Cover?
The Limited Warranty covers any defects in material or workmanship under normal use during the Warranty Period. During the Warranty Period, CCM will repair or replace, at no charge, product(s) or parts of a product that are proven defective because of improper material or workmanship, under normal use and maintenance. This Limited Warranty does not cover any damage, deterioration or malfunction resulting from any alteration, modification, improper or unreasonable use or maintenance, misuse, abuse, accident, neglect, exposure to excess moisture, fire, improper packing, power surges, or other acts of nature. This Limited Warranty does not cover any damage, deterioration or malfunction resulting from the installation or removal of this product from any installation, any unauthorized tampering with this Product or with Product firmware, any repairs attempted by anyone unauthorized by CCM to make such repairs or any other cause which does not relate directly to a defect in materials and/or workmanship of this Product. This Limited Warranty does not cover cartons, equipment enclosures, vehicle components, cables or accessories used in conjunction with this Product. Without limiting any other exclusion herein, CCM does not warrant that the product(s) covered hereby, including, without limitation, the technology and/or integrated circuits included in the Product, will not become obsolete or that such items are or will remain compatible with any other product or technology with which the Product may be used. The Limited Warranty does not cover any program, firmware or software. In the event an issue with software or firmware is realized, the customer shall be responsible for any and all costs to reprogram Products..
What will we do to correct problems?
CCM will, at its sole option, provide one of the following three remedies to whatever extent it shall deem necessary to satisfy a proper claim under this Limited Warranty:
- Elect to repair or facilitate the repair of any defective parts within a reasonable period of time, free of any charge for the necessary parts and labor to complete the repair and restore this product to its proper operating condition.
- Replace this Product with a direct replacement or with a similar product(s) deemed by CCM to perform substantially the same function as the original product.
What CCM will not do Under This Limited Warranty
If the Product is returned to CCM or the authorized dealer from which it was purchased or any other party authorized to repair the Product, the Product must be insured during shipment, with the insurance and shipping charges prepaid by the shipper. If this Product is returned uninsured, the shipper assumes all risks of loss or damage during shipping.
CCM will not be responsible for any costs related to the return of Products which are not covered under the Limited Warranty. CCM will not be responsible for any costs related to the servicing, troubleshooting, removal or re-installation of the Product from or into any installation. CCM will not be responsible for any costs related to any set up of Product (i.e. installation), any adjustment of user controls or any software or firmware programming.
How to Obtain a Remedy under this Limited Warranty (Warranty Returns Process)
To obtain a remedy under this Limited Warranty, the End-User must contact CCM, the local distributor or the the reseller from whom the product was purchased. In order to pursue any remedy under this Limited Warranty, the End-User must possess the defective part with its original serial number and batch ID. CCM may, at its sole discretion, request that the Product is returned to CCM prior to remedy (e.g. prior to delivering replacement Product) or within 60 days following the delivery of a replacement Product.
If the End-User fails to provide the defective part to CCM,
- CCM will charge the End-User, Distributor or reseller the full retail price of any replacement parts CCM has already delivered; and
- CCM will also charge the End-User or Distributor for any and all direct costs resulting from the shipping, handling, and/or customs and duty fees associated with replacement Product.
If CCM requires that the Product is returned under this Limited Warranty, a Return Goods Authorization ("RGA") number, obtained from CCM, must be clearly marked on the return package. Return packages not bearing an RGA number may be refused. A warranty return shipment or package may consist of multiple Products. All Products must be returned to CCM within the Warranty Period; products returned after the Warranty Period will be refused.
Limitation on Liability
THE MAXIMUM LIABILITY OF CCM UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE PRODUCT.
